Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Learnmeld website at learnmeld.com, the web application at app.learnmeld.com, and the AI tutoring features accessible through them (collectively, the "Service"), operated by Learnmeld ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Account registration
To use the Service, you must create an account with a valid email address and password. The Service is intended for users aged 16 and older. By creating an account, you represent that you meet this age requirement.
When you register, we automatically generate a unique username for your account. You may change your username later from your account settings.
By creating an account, you agree that:
- All information you provide is accurate and current.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You will contact us at [email protected] if you suspect unauthorized access to your account.
You may not create multiple accounts, share your account with others, or transfer your account to another person.
Use of the Service
Learnmeld provides an AI-powered personal tutoring platform that allows you to create customized AI teachers for any subject. The Service includes features such as chat-based tutoring, spaced repetition reviews, quizzes, error analysis, progress tracking, and gamification.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes, subject to these Terms.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes.
Subscriptions and billing
Plans
Learnmeld offers a free tier and paid subscription plans (Basic, Pro, Premium). Paid plans are billed monthly and processed through Stripe.
Auto-renewal
Paid subscriptions renew automatically at the end of each billing period. You authorize us to charge the payment method on file for each renewal period until you cancel.
Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. No partial refunds are provided for the remaining billing period.
Price changes
We may change subscription pricing with at least 30 days' advance notice. Existing subscribers continue at their current rate until they change their plan.
Refunds
Refunds are generally not provided for partial billing periods. If you believe you have been charged in error, contact us at [email protected] within 14 days of the charge.
Taxes
All prices are exclusive of applicable taxes. You are responsible for any sales tax, VAT, or other taxes imposed on your subscription, unless we are legally required to collect them.
Token usage
Each subscription tier includes a monthly allowance of AI tokens. Tokens are consumed for both input (your messages) and output (AI responses) during tutoring sessions.
- Unused tokens do not roll over to the next billing period.
- If you exceed your monthly token limit, AI features will be unavailable until the next billing cycle or until you upgrade your plan.
- Free tier accounts have a lifetime limit on teacher creations to prevent abuse.
- We reserve the right to implement fair-use policies for high-tier plans, including soft limits, throttling, and usage warnings.
Intellectual property rights
Our intellectual property
The Service, including its design, code, features, graphics, and trademarks, is owned by Learnmeld and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Service without our written permission.
The Learnmeld name, logo, and associated branding are our trademarks. You may not use them without prior written consent.
Feedback
If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
User content
You retain ownership of any content you provide to the Service, including messages, code snippets, and teacher configurations ("User Content").
By using the Service, you grant us a limited, non-exclusive license to process your User Content as necessary to provide the Service — for example, sending your messages to AI models to generate responses, or storing your teacher configurations for future sessions.
We do not use your User Content to train our own AI models. Your conversations are private to your account and isolated from other users. Your messages are sent to third-party AI providers (currently RunPod) to generate responses — please refer to our Privacy Policy for details on how these providers handle data.
You represent and warrant that your User Content:
- Does not infringe the intellectual property rights of any third party.
- Does not contain unlawful, harmful, threatening, or abusive material.
- Does not contain malware, viruses, or other harmful code.
AI-generated content
The Service uses artificial intelligence models to generate educational content, including explanations, quiz questions, code examples, and review materials. By using the Service, you acknowledge and agree that:
- No guarantee of accuracy. AI-generated content may contain errors, inaccuracies, or outdated information. You should independently verify any information before relying on it.
- Not professional advice. The Service is an educational tool and does not constitute professional advice of any kind (medical, legal, financial, or otherwise).
- No liability for AI output. We are not responsible for decisions or actions you take based on AI-generated content.
- Content variability. AI responses may vary between sessions even for similar prompts. The same question may yield different answers at different times.
Prohibited activities
You agree not to engage in any of the following:
- Using the Service for any illegal or unauthorized purpose.
- Attempting to circumvent subscription limits, token restrictions, or access controls.
- Using automated tools, bots, or scrapers to access the Service without our prior written permission.
- Sharing your account credentials with third parties.
- Creating multiple accounts to circumvent free tier limits.
- Uploading or transmitting harmful, abusive, defamatory, or offensive content.
- Attempting to reverse-engineer, decompile, disassemble, or extract the source code of the Service.
- Interfering with or disrupting the Service, its servers, or connected networks.
- Using the Service to develop a competing product or service.
- Collecting or harvesting personal information of other users.
We reserve the right to investigate and take appropriate action against anyone who violates these prohibitions, including suspending or terminating accounts and reporting to law enforcement where applicable.
Service availability
We strive to maintain the availability and reliability of the Service, but we do not guarantee uninterrupted or error-free access. The Service is provided "as is" and "as available" without any uptime SLA or warranty of availability.
We may, without liability:
- Perform scheduled or emergency maintenance that temporarily makes the Service unavailable.
- Modify, update, or discontinue features with reasonable notice.
- Experience downtime due to factors beyond our reasonable control.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LEARNMELD AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, OR GOODWILL, WHETHER INCURRED DIRECTLY OR INDIRECTLY, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
Term and termination
These Terms remain in effect for as long as you have an account on the Service.
Termination by you
You may delete your account at any time from your account settings. You will be asked to confirm with your password. Deletion is immediate and cannot be undone.
Termination by us
We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or if required by law. In cases of severe violations, we may terminate without prior notice.
Effect of termination
Upon termination of your account:
- Your access to the Service will be immediately revoked.
- Your data will be handled in accordance with our Privacy Policy.
- No refund will be issued for the remaining billing period.
- Sections of these Terms that by their nature should survive (limitation of liability, governing law, intellectual property) will continue to apply.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
Governing law
These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romania. If you are a consumer in the European Union, you retain any mandatory protections provided by the law of your country of residence.
